Der VfGH hat mit seinem Erkenntnis über die Aufhebung der Bundespräsidentenwahl 2016 unter anderem die frühzeitige Weitergabe erster Wahlergebnisse noch vor Wahlschluss an diverse ausgewählte Medienvertreter verboten. Die vorliegende Arbeit hat sich das Ziel gesetzt die österreichischen Wahlgrundsätze darzustellen, sowie in weiterer Folge auf die potentiellen Einflussmöglichkeiten durch moderne/digitale Kommunikationsmittel einzugehen. Dabei soll insbesondere auf die Problematik dieser Praxis aus verfassungsrechtlicher Sicht eingegangen werden. Im Speziellen auf die verfassungsrechtlichen Grundsätze der Freiheit und Reinheit von Wahlen. Des Weiteren wird das Phänomen der freiwilligen Aufgabe des Wahlgeheimnisses durch Abfotografieren und anschließendem Posten des eigenen Wahlverhaltens auf sozialen Plattformen beleuchtet und deren negative Konsequenzen aus verfassungsrechtlicher Sicht. Abschließend werden Lösungsmöglichkeiten für Wahlen im digitalen Zeitalter und die Auswirkungen des ergangenen VfGH-Erkenntnisses analysiert. |

By virtue of its decision to declare the presidential elections in Austria in 2016 null and void, the Constitutional Court prohibited among other things the premature dissemination of preliminary results of elections to selected representatives of the media before the close of voting. The purpose of this thesis is to explain the principles that apply to elections in Austria, in order to then look at possibilities of influencing elections with modern/digital means of communication. In particular, the problem of such practices is contemplated from the constitutional law perspective. A special focus lies on the principles of the freedom and purity of elections according to constitutional law. Furthermore, the study discusses the phenomenon of a voluntary waiver of the secrecy of the ballot by taking photographs of the ballot paper and then posting ones own vote on social platforms, as well as the negative consequences of this behaviour from the constitutional perspective. Finally, possible solutions for elections in the digital era and the impact of the decision passed by the Constitutional Court will be analysed. |
