Zusammenfassung

Am Beginn dieser Arbeit soll anhand des Rückblicks in die Vergangenheit gezeigt werden, welche Beachtung dem Schwangerschaftsabbruch in den jeweiligen Epochen zu Teil wurde, welche Ansätze sich über die Jahrhunderte gehalten und wie wir von ihnen noch heutzutage profitieren, beziehungsweise an diese angeknüpft haben. Bezugnehmend auf die geschichtliche Entwicklung, zeigt diese Arbeit die Komplexität der Straflosigkeit des Schwangerschaftsabbruchs, genauer der Fristenlösung nach § 97 (1) Z 1 StGB auf. Was die strafrechtsdogmatische Rechtsnatur der Fristenlösung beim Schwangerschaftsabbruch betrifft, gehen die Meinungen auseinander. In dieser Arbeit soll die Umstrittenheit der dogmatischen Einordnung im Vordergrund stehen und vor allem, aber nicht ausschließlich, die herrschende Lehre näher behandelt werden. Um das Bild abzurunden soll daneben zudem auch auf die Indikationen in § 97 (1) Z 2 StGB und abschließend, als Brücke zum Zivilrecht, auf die Schadenersatzfähigkeit in „wrongful birth“-Fällen eingegangen werden. Die Arbeit setzt sich in Zuge dessen insbesondere mit der Problematik der Vereinbarkeit der Straflosigkeit des Schwangerschaftsabbruchs gemäß § 97 (1) StGB mit den zivilrechtlichen Schadenersatzansprüchen aus der unerwünschten Geburt eines Kindes auseinander.

Abstract

This paper deals with the attention pregnancy termination has got in the past, focusing on certain epochs, the approaches that has been used over the centuries, how we profit from them today and, respectively, how we tie on them. Referring to the historical development, this paper shows the complexity of the impunity of the artificial abortion, more precisely the artificial abortion according to § 97 (1) Z 1 StGB. There exists a conflict of opinion about the legal nature of the dogmatic criminal law concerning the allowed time of an artificial abortion. Furthermore, the discussion about the dogmatic classification shall come to the fore and notably, but not exclusively, go into detail of the prevailing legal doctrine. To complete, the indications in § 97 (1) Z 2 StGB and conclusively, as a bridge to the civil law, the legal capacity of indemnity in cases of “wrongful birth” are to be analyzed and proved. As a consequence, this paper also deals with the problem of compatibility of decriminalization of the artificial abortion according to § 97 (1) StGB and the claim for indemnity by civil law due to the unwanted birth of a child.
