• Inhalt der Arbeit ist es, einen Überblick über die historische Entwicklung der öffentlich-rechtlichen Gefährdungshaftung in Deutschland vom 18. Jahrhundert bis heute zu geben sowie ihre praktische Bedeutung zu analysieren. Dabei wird zwischen den unterschiedlichen Gesetzgebungen, Rechtsprechungen und den theoretischen Lösungsansätzen der öffentlich-rechtlichen Gefährdungshaftung unterschieden und insbesondere letzteres problematisiert. Ferner wird auf das Verhältnis zu den grundrechtlichen Schutzpflichten, den sozialen Risikotatbeständen, dem sozialrechtlichen Herstellungsanspruch und den Tumultschäden eingegangen.
• The content of this work provides an overview of the historical development of strict public liability in Germany from the 18th century to the present day and analyses its practical significance. A comparison is made between the different legislations, case laws and the theoretical approaches of strict public liability throughout this time and in particular the latter is explored. This work highlights the relationship of the strict public liability to protection obligations of fundamental rights, the social risk factors of an individual such as one´s health or the inability to work due to injury, the claim to remedial action in social matters, and the damages caused by a tumult.
